WHAT IS INSOLVENCY REAL ESTATE ALL ABOUT?
The purchase of a property from insolvency involves a property belonging to an insolvent debtor. If a real estate company becomes insolvent, the insolvency administrator takes over the administration and sale of the assets in order to satisfy creditors. The administrator, usually a specialist lawyer, is responsible for the sales process and must achieve the best possible price. Creditors themselves can also influence the process. Insolvent properties are sold in two ways: via a so-called forced sale and, more frequently,by private treaty, i.e. to private buyers as normal. In this article, we take a look at the sale of insolvency properties by private treaty in Austria and the most important points to bear in mind.
HOW DOES IT WORK?
Valuation & expert opinion: The valuation is carried out by a court-appointed expert. A professional valuation is essential for a fair payment to creditors. They use various methods, such as the comparative value, income value or asset value of a property, all packed into a report that is usually 30 to 100 pages long. Important: The estimated price is also the lower limit or minimum price below which the property should/may not be sold. If a purchase offer were to be made below this estimated price, this would give rise to the suspicion that the assets were being squandered, which the insolvency administrator and court should of course not expose themselves to. In addition, this price creates transparency and trust among all parties involved.
Sale & offer: The sale begins with the appraisal, which is published (https://edikte.justiz.gv.at/) and can be viewed by anyone. However, insolvency administrators and surveyors are not available to answer questions about the property. I have personally experienced how some people have tried to view the property privately but have not received any further detailed information or answers to their questions. It is therefore advisable to go through an estate agent who specializes in insolvency properties, perhaps even has a legal background themselves, and who knows the process inside out and can provide you with massive support. Once you have decided on a property after careful examination, you can submit an offer to the insolvency administrator. Some require specific conditions for submitting an offer, such as the commitment period, while some insolvency administrators are more flexible.
Award & settlement: Ideally, you are the only bidder and the seller wins the bid. If there are several bidders in the running, the insolvency administrator has the option of either setting a deadline by which all bidders can submit a further bid or inviting the bidders to a court hearing where a bidding process takes place. Once the bid has been accepted, the purchase agreement is deemed to have been concluded. The buyer must then submit a purchase contract, which is agreed with the seller, and then transfer the purchase price to an escrow account held by the administrator. The final step is to go to the insolvency court, which still has to approve the purchase agreement. If the purchase price achieved is at or above the estimated value, you will usually receive this court approval without any problems. A practical tip at this point: Because the insolvency administrator's commitment to the purchase offer is already fully valid and court approval only postpones its validity, so to speak, it can make tactical sense to submit a commitment period for your own purchase offer that is as short as possible. If the trustee in bankruptcy then agrees, you may have beaten out other bidders who do not manage to submit their own purchase offer by the end of the commitment period. So time is of the essence here. Important note: Even after the purchase agreement has been concluded with the insolvency administrator, it is still possible to submit a higher offer before the court approves it. This makes it all the more important to act quickly with the help of a specialized real estate expert (like us).
DISADVANTAGES & RISKS
Overlooked defects: due to hasty purchase decision
Lack of warranty: Exclusion of warranty, no liability, as no assets available
Complexity of insolvency proceedings:
1. communication with the insolvency administrator is more complex, as he is not specialized in sales and can hardly provide any information. They usually only refer to the valuation report of the court expert. Other documents are usually not available, so communication and documentation on the property are too poor for most interested parties and professional support should be sought.
2. waiting period until the final approval of the purchase contract by the court;
3. no trustee - prepayment obligation without a trustee is unusual, but you pay into a separate trust account of the trustee in bankruptcy
Financing problems: no financing proviso, financing commitment must be in place
VAT: In the case of property developer bankruptcies, it can happen that a property is then sold with VAT. This must be taken into account when submitting the purchase offer.
ADVANTAGES & OPPORTUNITIES
Properties at or below market value: Why? The appraisal represents a general market value, but often does not include all aspects relevant to the purchase, as many appraisals often do not take into account factors such as micro-location, furnishing details or energy efficiency. In addition, many appraisals are prepared as so-called desk appraisals, without an on-site inspection of the actual property. And there may well be attractive estimates in terms of price. Here, too, it is important to consult a real estate expert or estate agent who can at least provide a second estimate of the property so that you don't buy too expensively.
Lower risks for the seller: A purchase from a bankruptcy estate typically involves considerably lower risks for the buyer than a purchase from a private or commercial owner, whose financial situation, reliability and dependability are often difficult to assess. In any case, a purchase from the liquidator eliminates the risk that the property will be sold several times or otherwise encumbered with a lien.
Deletion of liens / mortgages: Transferring the purchase price to a bankruptcy account also ensures that the purchase price is used to satisfy the bankruptcy creditors at a later date, which ultimately also results in the deletion of the liens and mortgages.
Sale for financial reasons: Conversely, this means that the probability of selling due to structural defects is lower in the case of insolvencies. Nevertheless, this does not exempt you from taking a very close look at a property, including its construction.
Lower ancillary costs: 1. since the insolvency administrator himself is the trustee of the insolvency estate and therefore no extra trustee is required, there are no trustee costs. 2. if you buy without the help of a real estate expert or broker, their fees are eliminated.
COMPARISON INSOLVENCY VS. PRIVATE PURCHASE
SUMMARY & RECOMMENDATION
There are often opportunities when buying insolvent properties, but there are also risks. Appraisals set a minimum price, but hidden defects and complicated processes are possible. It is therefore advisable to seek advice and support from an expert when buying insolvent properties - from gathering information, viewing, appraising and assessing the advantages and disadvantages of a property to communicating with the insolvency administrator.
So, despite the greater complexity, which a professional estate agent more or less offsets for a potential buyer, the purchase of such a property can be a worthwhile acquisition if approached correctly.

Historical facts about the Liesing district
Liesing was created in 1938 as Vienna's 25th municipal district through the merger of several previously independent municipalities and has existed in its current, reduced form since 1954/56. The eight parts of Liesing were thereby added to the political district of Hietzing, which at that time was still located outside the city of Vienna. When the north of this district was incorporated into Vienna as the 13th Municipal District of Hietzing, a decree of the Ministry of the Interior, effective as of 1892, provided for the establishment of a new Political District of Hietzing Umgebung. Hietzing Umgebung consisted of the villages in today's municipal district of Liesing as well as Perchtoldsdorf, Purkersdorf and Vösendorf, among others. In 1904, the Liesing judicial district was created, which initially comprised all districts of the present municipal district with the exception of Kalksburg, Mauer and Rodaun and also included Vösendorf. This measure was another significant preliminary step towards the establishment of a Viennese municipal district under the name of Liesing.

Historical facts about the district Floridsdorf
Floridsdorf was founded in 1904 by incorporating the town of Floridsdorf and some surrounding villages. Some of these villages later changed to the 22nd district Donaustadt. The first settlements in this area occurred in the Younger Stone Age (about 4000 to 2000 BC). Throughout history, the area was settled by various peoples, including Celts, Romans, Lombards, Avars and Slavs. In 1014, the Floridsdorf district of Jedlesee was first mentioned in a document. Industrialization in the 19th century and the First Vienna Danube Regulation in the 1870s contributed significantly to the development of Floridsdorf. The Danube regulation not only enabled a stronger connection of Floridsdorf to the city of Vienna, but also growth through the creation of new, flood-proof building land. Floridsdorf was incorporated into the city of Vienna in 1905 and has since formed the 21st district. At that time, the district included Floridsdorf with the villages Jedlesee, Großjedlersdorf, Donaufeld, Leopoldau, Kagran, Hirschstetten, Stadlau and Aspern.

Historical facts about the district Brigittenau
Brigittenau was largely developed on the new land gained by the Vienna Danube regulation of 1868-1875. Brigittenau has no distinctive historical center and was part of Vienna's 2nd municipal district, Leopoldstadt, from 1850 until it was separated from it in 1900. The first known owners of this area were the Babenbergs in the 11th century. The area was given by Leopold III around 1096 to the monastery of St. Maria Nivenburg (today's Klosterneuburg Abbey), which he founded. The first settlers were fishermen, hunters and woodcutters. Later, gardeners and innkeepers also settled here. In the course of the First Viennese Turkish Siege in 1529 there were heavy battles on the territory of the then Danube islands. Also during the Second Vienna Turkish Siege in 1683, the Wolf's Lair and the area of today's Peace Bridge were fiercely fought over. During the Thirty Years' War, the Swedish army under Lennart Torstensson captured the Wolf's Lair on April 9, 1645. Imperial troops recaptured the area in a four-day battle at what is now Brigitta Chapel. Another major flood in 1862 led to concrete planning for the regulation of the Danube in Vienna: construction of the extensive regulation measures began in 1870, as did the construction of the Northwest Railway Station on the site of the former "Universum" near today's Tabor.

Historical facts about the district Döbling
The district was formed in 1892 from the former Viennese suburbs of Unterdöbling, Oberdöbling, Grinzing, Heiligenstadt, Nussdorf, Josefsdorf, Sievering and the Kahlenbergerdorf. In 1938, the district was expanded to include Neustift am Walde and Salmannsdorf, which previously belonged to the district of Währing. The history of Döbling goes back a long way. The area was already settled about 5000 years ago and, along with the Simmering-Landstrasse area, probably represents the oldest settlement area in the Vienna region. Over the centuries, the area was repeatedly affected by wars and epidemics, including the Turkish sieges and the plague epidemics. In the 19th century, Döbling experienced an upswing and became a popular excursion destination for the Viennese. With the incorporation of Vienna's suburbs at the end of the 19th century, Döbling became Vienna's 19th municipal district.

The name Währing was first mentioned in documents around 1170 as Warich. There is only conjecture about the origin of the name. Possibly it is of Slavic (var for warm spring or varica for dark stream) or Germanic origin (werich for day's work, i.e. a field of a size that a man can work on in a day), possibly it is also derived from Werigandus, the first abbot of the Michelbeuern monastery. In 1892 the former suburbs of Währing, Weinhaus, Gersthof, Pötzleinsdorf, Neustift am Walde and Salmannsdorf were incorporated and the new district was formed from them. In 1938, however, the districts of Neustift am Walde and Salmannsdorf were largely incorporated into the district of Döbling. The history of Währing is characterized by various phases of incorporation and restructuring. After the incorporation of the suburbs in 1850, the discussion about the incorporation of the suburbs began in the 1870s. The initiative for this came from Währing. At the opening of the Türkenschanzpark in 1888, Emperor Franz Joseph I gave a speech in which he hoped that the suburbs would soon be united with the imperial capital and residence city of Vienna. As a result, the Lower Austrian Parliament decided in 1890 to unite 34 suburbs with Vienna. The law came into force in December 1890; the unification of these suburbs with Vienna was to be completely implemented by January 1, 1892.

Historical facts about the district Rudolfsheim-Fünfhaus
The village centers of the former suburban agglomeration around Fünfhaus and Rudolfsheim, which date back to the Middle Ages, are located in the southern part, while the northern part (Schmelz), where slightly more than half of the district's inhabitants live today. After the second Turkish siege, the villages of Reindorf, Braunhirschen and Rustendorf were formed, which were united in 1863 to form the municipality of Rudolfsheim (named after Crown Prince Rudolf), with Fünfhaus to the east and Sechshaus to the south. In the 19th century the whole area was densely built up. Under Nazi rule, as of October 15, 1938, Rudolfsheim and Fünfhaus were united to form the 15th district, and district number 14 was freed up for Penzing. In the process, a boundary correction added a small area of twelve house blocks to the district, which is occasionally called "Neu-Penzing". Since 1957 the 15th district is called Rudolfsheim-Fünfhaus.
In 1958, the Wiener Stadthalle was opened, Vienna's largest event center. The Auer-Welsbach Park came in 1992, in the course of a boundary change, from the 14th to the 15th district.

Historical facts about the district Alsergrund
The Alsergrund is the 9th district of Vienna and is located within the Gürtel, which was built in place of the former Linienwall. The district name is used with article, for the reference to the district area the preposition am is used instead of in/im. Alsergrund consists of Wilhelminian style neighborhoods. The district Alsergrund was formed in 1850 from seven suburbs. The names of the suburbs have survived to this day in names, but also in the consciousness of many residents. The earliest excavations at Alsergrund date back to Roman times, when the Limes ran through the district. The first settlements were made around the year 800 by Bavarian colonists, who founded St. Johann an der Als, one of several stronghold-like church settlements along the Limes.
The 18th century saw a building boom, with aristocrats building their palaces on the favorable grounds outside the city walls, especially in the southern Alservorstadt. The northern Alsergrund continued to develop into a center of sanatoriums and nursing homes, and in it the landlords had fields parceled out and houses built on them by craftsmen and innkeepers.
After fires in 1805 and 1809 and an outbreak of plague as a result of the occupation by French troops during the Napoleonic wars had afflicted the Alsergrund, economic enterprises such as the porcelain manufactories did not recover until 1815.
